Insurance Problems

wel there

im not a happy camper
so here is my rant

i was pricing around for insurance for the passat
my cheapest was 1471 euro with avia car insurance ON THE 1/7/11

the usual questions was asked

full clean lic
4 years named driver exp
over 10 k miles a year
tyre fitter

live in ardee
full comp with third party cover on other car

WAS NOT ASKED ANY CAR MODIFICATIONS

ON THE 6/7/11
I told them i wanna go ahead with this policy

on the 7/7/11
the passat hit the road

on the 13/7/11
i get a letter from the insurance company just to make sure all the details are right and sign
at the bottom but me being me a read threw it

its says i was asked any car modifcations and i answered no
which is not ture i was never asked

so on the 14/7/11
i rang them was talking to them and said i was not asked was there any car modications
and he said thats fine dean have you anything to declare i said yes

body kit 19inch alloys airbag suspension and twin exhausts

he said ok i will get back to you in a few mins and after 5 mins he came back
hi dean i cant get threw to my manger that deals with this i will call you back sortly

a hour later i had a missed call on my voice mail
hi its car insusance yes the modifcations you declared are fine
you are still fully covered
your policy price does not rise and thank you for declareing them even doh you were not asked

you disc wil be out in a few days

today just one hour ago
i get a call

hi dean
i have bad news
due to the modifcations to your car
we have no other choice but to cancel you policy
it is company policy that first time customers can not have modifed cars
i regret to infom you a this

i asked but this not not my fault i was never asked but decided to delcare and this happins

his reply was thank you for coopertaion with us and delcaring this but im sorry we cant change poicly

IM NOT HAPPY

i second that. the contract both you and they agreed to is what they need to stick to, they cant just change it at a whim. i reckon they're just trying to get you to accept the cancellation as they've made a fuck up and are trying to rectify it. is there an office you can go into rather than talk on the phone? i find face to face "conflict" is better for getting stuff sorted.

EDIT: theres an office here in drogheda, they seem fairly ok, i had it out with them coz they put my insurance up by 60 euro on a classic policy. eventually they took it back down to the 190 euro it was supposed to be.

Everyone is making the right noise. I work for an insurance company and if they agreed it over the phone they have to stick with it no matter if you had signed the declaration or not. Verbal contract is still a contract. Don't accept the cancellation.

You could fight the good fight and you may be able to hold them to the contract but i'm sure there is a loop in the contract that allows them to withdraw, the other thing that i would take from it is if this is how they treat you over a small clerical error on their part what's going to happen in the event of a claim.

I use a broker called Creane and Creane in Enniscorthy in wexford, they're the crowd that run bestquote.ie

They always give me very good cover. I'm 25 with a 5 years no claims bonus and my 2.5tdi 180 bhp costs me 650 euro per year fully comp.

I wouldnt deal with anyone else, they're incredibly professional and unbelievably easy to deal with.

and would they understand wen im loking for cover to make sure they mention the modified bits on the car...

You're car still goes and stops like a standard car, sure its aesthetically different and it has a trick suspension system but in the event of an accident I dont think your car would behave any differently to a standard car.

I think the gray area is how to value your car with the work that you've done. In the event of an accident would you expect to get the value of a similarly spec'd passat or would you expect to be paid out for your car plus the value of the mods?

It would be interesting to know what others think about this.
If i were in your shoes i would insure the car without mentioning the mods as they are purely aesthetic, maybe i would be wrong in doing that.

hi david you would be wrong in that i fell
as if you do not notify the insure of your mods your lyin to them
in that case and i have seen this happin the car is classed as not insured
in a accident they would not cover it
and im a witness to that

not with the price of the mods
im not looking them covered in a way as it is dead money i would in case of a accident just to be payed in the value of the car

im sure 99 per cent of modified in this county are not iegally insured

insurace company just wait for one reason and one reason alone
not to pay out after a claim

and i didnt wanna give them that reason god for bid something happins to me

Few years back I called my broker about insuring a Sierra Cossie, I got a quote for €1700 so I went and bought the car.
I then called back to sort payment and they said they made a mistake and it was €1700 on top of the 2k I was paying on the VR6 at the time.

When I explained I had bought the Cossie on the grounds I could insure it, they had no choice but to insure me for €1700.

Can you tell them you bought the car after you got the go ahead from them?

I hear what you're saying but i'm not sure i agree with you. My previous car was a Bora, i spent nearly 5k on bits and pieces for that car and as far as i'm concerned it was not a modified car in terms of insurance.
I changed nothing in terms of power or stopping, the performance of the car was not changed. If i'm not insured because I have better tyres, lights and suspension then someone who has cheap tyres on their car which are not to the manufacturers spec then surely they are not insured?

Ring em back and say you're stuck because of them. You have committed to bring the car to collect your granny in roscommon and that there's no other option. Nobody likes to see a granny stranded.

Face to face. Only job if you're prepared to dig your heels in and not take no for an answer.

UPDATE AND GOOD NEWS

after speaking with the office of fair trade and financial ombudsman

i was informed by them they what avaia actually done and was against the law

as it was there fault that they didnt ask me about them modifcatins and cancelled my insurance over there mistake

so i got in contact with them

now the man i was dealin wit for the quote and taking up the poilcy was a nice man
i actually got that to the WOMAN in the office that decided to cancel it

i informed her about my vocial mail
that i was not asked about modifactions
what she done was against the law also has left me stuck

i also threw a bit of sloictor sentances in the for the crack
and my reply was

there no longer cancelling my insurance
the disc wil be out in a number a days
the delcartion letter will come out with modifacations answered yes
also with the details of what i have listed to them

and they could not be more sorry for the haale they caused

happy days ...
